1. Acceptance of Terms

By accessing or using the TrueValuate website, mobile application, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to all of these Terms, do not access or use the Service. TrueValuate reserves the right to modify these Terms of Service at any time. Your continued use of the Service following the posting of changes constitutes your acceptance of such changes.

2. Description of Service

TrueValuate provides AI-powered property valuation estimates based on publicly available data, MLS records, and proprietary algorithms. The valuations provided are for informational purposes only and do not constitute a formal appraisal. TrueValuate is not a licensed appraiser and does not provide appraisal services. For official property appraisals, please consult a licensed appraiser.

3. Communications & Consent

By pressing “Request Tour” or submitting your information through the Service, you are contacting a buyer's agent. You agree that TrueValuate and its affiliates, and real estate professionals may call or text you about your inquiry, which may involve the use of automated means and prerecorded or artificial voices. You do not need to consent as a condition of buying any property, goods, or services. Message and data rates may apply.

TrueValuate does not endorse any real estate professionals. We may share information about your recent and future site activity with your agent to help them understand what you're looking for in a home.

4. Automated Valuation Reports Disclaimer

Our valuation reports are generated using automated models and publicly available data. They are:

  • Not professional real estate appraisals or formal valuations
  • Intended for informational purposes only
  • Should be reviewed and confirmed by qualified real estate professionals before making any financial or real estate decisions
  • Not guaranteed to be accurate or complete

5. User Accounts & Registration

Certain features of the Service may require you to provide personal information, including your name, email address, and property address. You agree to provide accurate, current, and complete information and to update such information as needed. You are responsible for safeguarding any credentials associated with your use of the Service.

6. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, data compilations, software, and the overall design — are the exclusive property of TrueValuate or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable law, regulation, or these Terms of Service.
  • Infringe on the rights of others, including intellectual property rights.
  • Transmit any harmful, threatening, abusive, or otherwise objectionable material.
  • Attempt to gain unauthorized access to the Service, other accounts, or computer systems.
  • Use any automated means, including bots, scrapers, or spiders, to access or collect data from the Service without prior written consent.
  • Interfere with or disrupt the integrity or performance of the Service.

8. Disclaimer of Warranties

TRUEVALUATE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY VALUATION ESTIMATES WILL BE ACCURATE OR RELIABLE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TRUEVALUATE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE.

10. Indemnification

You agree to indemnify, defend, and hold harmless TrueValuate, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service or your violation of these Terms of Service.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms of Service shall be subject to the exclusive jurisdiction of the courts located in the State of California.

12. Termination

TrueValuate may terminate or suspend your access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms of Service. Upon termination, your right to use the Service will immediately cease.
